These Terms of Service govern your use of our services, including the scanning and sharing of printed photographs. By using our services, you agree to comply with these Terms. Please read them carefully before proceeding. 

Consumers availing themselves of our services retain full entitlement to their statutory consumer rights and remedies as established by the European Union.

Limitation of Responsibility

Submitting any tangible or electronic media, image, data, file, card, disc, device, film, print, slide, or negative for scanning, processing, printing, duplication, alteration, enlargement, storage, transmission, or any other handling by you to Photo Scans Ireland constitutes an agreement by you that any damage or loss by our company, subsidiaries, or agents will not entitle you to any recovery, and no warranty is entered into. You explicitly understand and agree that you are not entitled to any damages, including but not limited to consequential damages, for any reason or service provided by the Company. The Company's services are provided "as is" and without fault, and the Company hereby disclaims all other warranties and conditions, whether express, implied, or statutory, including any implied warranties, duties, or conditions of merchantability, accuracy, or completeness of the provided services.

Limitation of Remedies

In the event of any dispute or issue with our services, your sole and exclusive remedy shall be limited to store credit up to the amount of the disputed transaction. You understand that no additional incidental, punitive, indirect, consequential, or other damages will be granted or warranted.

Liability Exclusion

Photo Scans Ireland, its subsidiaries, and agents shall not be liable for any incidental or consequential damages. We operate with the highest standards of care and professionalism, and our commitment to preserving your cherished memories remains unwavering. You are responsible for providing accurate information about the number of photographs, slides, negatives, or other media sent for scanning, and you agree to pay for all media submitted.

Non-Liability for Customer-Supplied Materials

We do not assume any liability for customer-supplied materials, such as photos, frames, paintings, artwork, etc., that are submitted with orders. We are not responsible for any loss or damage to these materials by fire, theft, loss, or any other means.

Service Specifications and Prices

All prices and service specifications are subject to change without notice. Once any of our services have been ordered, all sales are final, and no cancellations or refunds are provided. The price of our services shall be as stipulated on our website, with errors and omissions excepted. Photo Scans Ireland is not VAT registered.

Shipping and Delivery Risks

Customers are advised that shipping anything, regardless of the courier or delivery service selected, carries inherent risks. Photo Scans Ireland assumes no responsibility for any loss and/or damage to the customer’s materials while they are in transit by mail, courier, or transport companies. We cannot warranty or guarantee the safe arrival of your order and will not be liable for any loss or damage during transportation.

Reliable Courier Services

Photo Scans Ireland only uses reliable and professional courier services that provide a tracking system for all collection and return delivery requirements, including signature on delivery where possible. While we take precautions, we cannot be held responsible for any service interruptions that may occur. In such instances, Photo Scans Ireland will work with the courier to seek an urgent resolution. As of the publishing date of these Terms (July 2023), Photo Scans Ireland confirms that no orders have ever been lost or damaged since trading.

Lost, Damaged, or Delayed Items

Photo Scans Ireland accepts no responsibility for lost, damaged, or delayed items while in transit to or from us. We obtain posting receipts and will notify you upon receipt and dispatch of your photographs.

Delivery Address

Customers shall assume full responsibility for providing an accurate delivery address at the time of placing the order. In the event that rerouting or redelivery becomes necessary, the associated costs shall be borne by the customer.

Quality of Scans

Our high-speed photo scans are designed to digitally preserve regular photos and may not meet museum-quality clarity for professional images. We always strive to produce the best quality scans, but the results are dependent on the quality of the original material provided to us. We cannot be held responsible for failing to scan an image to a sufficient level if the damage to the original image is too great or the quality is poor.

Imperfections and Editing

Our scanning services will not automatically repair damage, scratches, or marks on the original photographs or slides. Imperfections may appear on the scanned images. 

Proper Packaging

All photographs should be supplied out of mounts, frames, and without any other properties attached, such as mounts, glue tabs, blu-tack, Sellotape, staples, etc.

Ordering Instructions

Please ensure clear instructions are provided for the service, if required. If no instructions are provided, we will process orders using our standard service where images are not arranged in any particular sequence.

Turnaround Time

While we aim to complete all orders within 30 days, we cannot guarantee time scales for processing as our levels of business vary. On average, orders are processed within 14 days — this begins from the time your images are received at our office until you receive the digital scans.

USB Device

If the supplied USB device arrives damaged or faulty, please notify us within 14 days of your order being received, and we will send a replacement.

Use of Scanning Results

Photo Scans Ireland will never publish your scanned photos or images on any of our websites or share them with any third-party companies or websites. Your privacy and the confidentiality of your scanned images are of utmost importance to us.

Image Ownership and Copyright

By submitting your photographs and slides to Photo Scans Ireland, you confirm that you either own the copyright to the images or have obtained the necessary permissions to use and reproduce them.

Privacy and Confidentiality

Photo Scans Ireland undertakes never to publish your photos or images on any of our websites or with any third-party company or third-party websites, unless with explicit written agreement. Your confidentiality is guaranteed.

Data Security and Retention

Your scanned images will be retained on our secure internal data server for 30 days, during which time you have the option to request permanent deletion. After 30 days, the images will be permanently deleted from our server. Photo Scans Ireland recommends backing up your scanned images as soon as you receive them to safeguard your precious memories.

Communication and Notification

All communication regarding order processing, delivery, and potential issues will be primarily conducted via email or text messages via WhatsApp. Please ensure the email address and mobile phone number provided during the ordering process are accurate and regularly checked.

Problem Resolution

In the highly unlikely event of a problem, we will investigate and aim to resolve it as a priority. However, we cannot provide financial compensation other than a partial refund.

Customer Service

If you are not satisfied with the scanning results, please notify us via email or telephone at the earliest opportunity. We will strive to ensure your satisfaction and attempt to correct any issues, including rescanning if necessary.

Acceptance of Terms

By using the services of Photo Scans Ireland, you acknowledge and agree to abide by these Terms of Service in their entirety.
